Stanley sentenced to 45 years

A Huntington man convicted of child molestation was sentenced to serve 45 years in the Indiana Department of Corrections, Nov. 20, with no time suspended, after a jury found the defendant guilty on Nov. 1,according to court records. 

The Level 1 felony charge of child molestation carried an potential sentence between 20 to 40 years, but since David Allen Stanley, 55, met the criteria of a credit-restrictive felon, the sentencing range increased to anywhere from 20 to 50 years. 

A credit-restrictive felon is when the person is at least 21 years of age and molests a child who is younger than 12 years old, according to Indiana Code. Police reports show that the victim was younger than 12 at the time of the incident.

In October 2016, officers from the Huntington Police Department began investigating a case in which Stanley was accused of sexually violating a minor, according to police reports. The victim told police and doctors that their genitals hurt after the incident. Stanley denied the allegations and reportedly told police that the touching could have happened accidentally as he attempted to move a chair for the victim.

He refused to take a polygraph test, saying the results are not admissable in court and unreliable, but agreed to allow police to take a DNA sample, which “failed to demonstrate a sufficient quantity” of DNA according to police reports.

Stanley served 10 months after he was accused of child molesting around 2003, according to police reports. He also told police that he had been accused of fondling a neighbor but nothing came of it.

Stanley will receive credit for time served between April 19 and May 5, Nov. 1 and Nov. 20 and is being transported to IDOC.
